New York – New York (AP) – Harvey Venstein’s #MeToo retric will be largely a brief version of the original to a large extent, with a large addition: a woman’s charge -based charge that was not part of the case before.
The disgruntled film Mogul should focus on Wednesday to explain the prosecution of Mogul, when a judge is prepared to issue a ruler on various issues, including the accused testimony and scope of potential expert witnesses.
72 -year -old Venstein is expected to be in court when Judge Curtis Farber Rules.
His retric is scheduled to begin in the state court in Manhattan on 15 April – almost a year after the New York Supreme Court overturned his 2020 sentence on allegations of rape and sexual harassment.
In January, in the presence of his final court, Venstein inspired Farber to start as soon as possible. He told the judge that “I don’t know how long I can hold with cancer, heart issues and rigorous conditions in the Ricker Island Jail Complex in New York City, where it is closed.
Wenstein is being brought back on the allegations that he had forcibly oral sex on a film and TV production assistant in 2006 and raped an ambitious actor in 2013. Additional allegations filed last September alleged that he forced a separate woman to oral sex at a Manhattan Hotel in 2006.
The office of Manhattan District Attorney Elvin Brag said in court papers that the woman, which has not been publicly identified, came forward to prosecutors a few days before the start of Venstein’s first test, but was not part of that case.
The prosecutors said that they did not chase the women’s allegations after being convicted and sentenced to 23 years in jail, but they saw them again and received a new prosecution after the state court of appeal, which had thrown their sentence in the last April.
In October, Farber ruled to combine new prosecution and existing allegations in a test.
Wenstein’s lawyers say the prosecutors waited for nearly five years to stop them from prejudice, suggesting that they had chosen not to include the charge in their first test so that they could use it later if their sentence was reversed.
Wenstein has denied that he has raped or sexually assaulted someone.
Last month, Venstein added a lawyer Jennifer Bonzen, who, who Bill Cosby and R. Kelly is represented, in a legal team, including defense lawyer Arthur Edala, Diana Faby Samson and former Judge Barry Kamins.
In vacating Venstein’s sentence, the Court of Appeals ruled that the trial judge, James M. Burke had wrongly allowed testimony against other women on the basis of allegations that were not part of the case. Burke is no longer on the bench and such testimony will not be a part of retric.
Wenstein was convicted for another rape in 2022 in Los Angeles. His 16 -year jail sentence is still standing in that case, but his lawyers appealed in June, arguing that he did not get a fair test.
