Washington – A small American federal agency who invests in African small businesses is expected to fight in court on Tuesday to control its operation and existence.
The US African Development Foundation tried to keep the employees of the Government Efficiency Department of Elon Musk by entering its offices in Washington last week. Dogi’s employees managed to get admission after returning with the American marshal.
USADF Chairman Ward Breem sued the Trump administration last week, in a complaint that the attempt to acquire was illegal and neither President Donald Trump nor Dogi had the right to shut down their operations or change their board members and President.
Hours later, American District Judge Richard J. in Washington. Leone temporarily stopped the administration from changing the leadership of USADF. Leone will hear on Tuesday about representing government lawyers and Attorney’s Briham whether the Trump Administration can remove members of the board and make new appointments.
Trump had targeted USADF and three other agencies in an executive order last month, which was closed in an attempt to fulfill the promises of the campaign to reduce the size of the federal government. The independent agency was formed by the Congress in 1980 and is controlled by the board members, which should be confirmed by the US Senate.
A primary question in the case is whether the Trump administration has legal rights to remove independent board members. Presidents are banned from firing these members without any reason, thanks to the decision of the nearly 90 -year Supreme Court, known as the executive of Humphri, who has been a backstop for advocates in court against the Firing of Trump administration. More recent Supreme Court decisions have expanded the power of the President’s removal and legal experts say the orthodox majority of the High Court may be willing to reverse that example.
In a filing on Monday, the government lawyers claimed that the Trump administration had removed the members of the USADF by email from the White House last month. USDAF challenged the account stating that only one board member, Brehm received an email to remove one.
The remaining board members made Brehm President on 3 March. The previous USADF president resigned before the agency was abolished.
The Trump Administration lawyers have argued that the USADF board has “made every effort to avoid compliance with the President’s clear instructions,” and “the President must be able to nominate acting officers to fulfill its duties to implement laws.”
In 2023, the Congress allocated USADF $ 46 million to invest in relatively small agricultural projects and energy infrastructure projects in 22 African countries. The agency employs about 50 people.
In court filing, USADF described the employees of DOGE seeking access to their system, which the employees refused, citing confidentiality and security requirements. He also said that Dogi had emailed USADF employees last month, which announced that USAID deputy administrator PT Maroco oversees its disintegration, will chaired the Board of USADF.
Marocco and some similar dog staff have been successful in closing the Inter-American Foundation, another independent agency. On February 28, an official of the White House told an IAF employee that according to a letter sent by the IAF board to the Congress by the IAF Chairman Eddie Ariola, the board would head the board of the Maroko agency.
On the same day, MarocCO held an emergency board meeting outside IAF’s offices as it was not able to get admission in the building. In the notes entered into the Federal Register, Maroko said that he nominated himself as acting CEO and president of IAF, appearing that the sitting chairman was fired.
Since, IAF grants and contracts have been canceled and most of its 37 staff members have been closed. In 2024, IAF looked at about $ 350 million in investment in Latin American and Caribbean, which means from countries coming from out of funds from outside funds or private funds.
