Karnataka HC ordered a trial court to take cognizance of crimes against EX-CM in the POCSO case

On March 14, the High Court of Karnataka stayed the trial court’s order to take cognizance of crimes against former Chief Minster BS Yeddyurappa, which was filed under the provisions of children’s protection (POCSO) Act, 2012 from sexual offenses, which was accused of sexual harassment in February 2024 for sexual harassment on their residence.

Justice Pradeep Singh Yerur passed an interim order on a petition filed by Mr. Yeddyurappa. The interim order will apply until the petition is postponed by the High Court.

Re -chosen

Mr. Yeddyurappa challenged the first information report registered on March 14, 2024, which took place on February 2, 2024, a charge sheet filed by the Criminal Investigation Department (CID), and on 28 February 2025, the trial court order to take cognizance of crimes.

The trial court had passed an order to carry cognizance on 7 February 2025, the order passed by the High Court, which was passed on July 4, 2024, was ordered as a trial court to carry the trial court order as ‘Bald, Lyconic and Cryptic’, which was ordered in terms of criminal courts. On February 28, on the order of taking cognizance of crimes and calling the accused persons, the High Court said that Mr. Yeddyurappa and other accused were also exempted from appearing before the trial court personally before their petitions, as the order was given since July 2024, as the order was ordered during the order by the court.

Delay in filing complaint

On behalf of Shri Yeddyurappa, it was argued by senior advocate CV Nagesh that a complaint was filed after a delay of about a month, and in fact, no sexual assault occurred. All the witnesses, including the President of the Karnataka Working Journalists Association, who were present at Shri Yeddyurappa’s residence on 2 February 2024, clearly stated that no such incident of sexual harassment occurred, as the complaint was reportedly recorded by the girl’s mother, and in voluntary details given by the victims.

State Advocate General Shashi Kiran Shetty opposed the proceedings before the trial court, while the High Court said that in the 7 February order, only the manner was found in the manner in which cognizance was taken, and clearly stated that the material filed against the accused in the charge sheet was required to test in a fully developed test. The AG also said that staying in the proceedings would not be in the interest of the victim as the test in POCSO will have to track rapidly according to the law.

The High Court also took action against other accused, who are facing charges of bribing the complainant to close the case.
